The brothers could be released immediately if the judge grants District Attorney Gascón’s request for a resentencing, which could be for manslaughter. Gascón has requested a hearing to consider sentencing modifications; the court has scheduled that for December 11. Nevertheless, the clemency plea that the brothers’ lawyer submitted this week would circumvent the resentencing procedure that Gascón started.

The defense also cited a letter Erik had written to his cousin in the months leading up to the murders as evidence that Erik had been a victim of abuse.
